Text Registration: Opt-In Language and Privacy Policy

Opt-In Statements

Opt-In Language for Businesses or Organizations Not Collecting Donations

Insurance, Financial, Legal, Home Services, Mortgage, Real Estate, and other businesses that do not collect donations as a primary source of income can use this language.

Offline Verbal Script

Offline Verbal Scripts should ONLY be provided if there is no form on the business’s website collecting phone numbers. Submitting an Offline Verbal Script or Form when phone numbers are being collected through a site’s contact form, the account will fail by default.

Update with Business Details, Copy, and Paste onto Registration Form

Levitate's text registration form will submit your registration form directly to The Campaign Registry as well as to our upstream carrier. If you are a business sending text messages, please use the language verbatim, as we have vetted it directly with our upstream carrier. It is important to only update your business's name, and to not change or exclude other verbiage!

"Business Name will be collecting opt-in verbally from their contacts. They will be able to opt-in to receive messages either in person at their physical location, or over a phone call if they call. When they speak for the first time, they will be asked to provide their phone number, and staff is trained to ask if they would like to opt-in to SMS-based marketing, updates, and informative messages. They will be verbally informed that "message and data rates may apply," "message frequency may vary," and they can "text HELP for support or more information and STOP to unsubscribe at any time." They will also be informed that their phone number will not be shared with third parties for marketing or promotional purposes. Privacy Policy and Terms & Conditions have been provided in the TCR registration form under Call to Action/Message Flow.

Once opting-in verbally a text will be sent, and it will include the same opt-in language provided verbally. It will give the contact another option to opt-in or opt-out.

This is Business Name. Reply YES to confirm you want to receive marketing, updates, and informative SMS messages. Message frequency may vary, and message and data rates may apply. Consent is not a condition of purchase. You can reply STOP at any time to unsubscribe or opt-out, or HELP for help."

How Online Forms Should be Formatted

Is the phone number field required on the form?

If this field cannot be made non-required, a checkbox or some way for the consumer to choose NOT to opt-in for texting is required.

Start with “By checking this box.”

Is the phone number field not required on the form?

If the phone number field is not required, there doesn’t necessarily need to be a checkbox because the consumer has the ability to provide their phone number or not. Generally, folks will provide their phone number and it doesn’t hurt to have a checkbox if available for affirmative consent.

But, if there is no checkbox available, start with “By providing my phone number” or “By submitting this form.”

Opt-In Language for Non-Profits and Organizations Collecting Donations

This language is specifically for nonprofits and organizations that collect donations. If your account is not collecting donations in any way through their website, default to the language used for businesses– i.e., marketing, updates, and informative texts, even volunteer asks. Donations need to be specifically named in opt-in language.

Offline Verbal Script

Offline Verbal Scripts should ONLY be provided if there is no form on the non-profit or org’s website collecting phone numbers. Submitting an Offline Verbal Script or Form when phone numbers are being collected through a site’s contact form, the account will fail by default.

Registration Red Flags  🚩

What will keep me from passing registration with the upstream carrier?

  • No opt-in language on your form collecting phone numbers! Automatic failure.
  • No privacy policy! Automatic failure.
  • No website or web presence. A landing page will do– the website provided just needs to be accessible and secure.
  • Submitting an offline verbal script when collecting numbers on your site. If you are collecting numbers on your site, you must disclose the URL and make sure the form is compliant.
  • Forced Consent: If you are collecting phone numbers on an online form and there is no way for the consumer to choose not to receive text messages from you, even if they want to provide their phone number. The best choice here is to have a checkbox that allows consumers to affirmatively opt in to receiving text messages from you.
  • Non-precise language: the opt-in and privacy policy language above has gotten hundreds, if not thousands, of our clients registered to text. It has been vetted by our upstream carrier, and we highly recommend that you use it, verbatim, on your website and registration form.
  • For non-profits and orgs collecting donations: no mention of donation requests in your opt-in language.
  • For businesses: no mention of marketing in your opt-in language.
